District I Councilor Charlie Mariano yesterday disclosed that he is ready and willing to vacate his position as an elected member of the local legislative body once the decision of the Commission on Election disqualifying him from holding the position would already be carried out by the Department of Interior and Local Government (DILG).

Mariano’s pronouncement came after his legal counsel expressed doubts whether they still have material time to seek temporary restraining order (TRO) since under the Comelec rules they are only given five days to secure it.

The Comelec in its en banc decision dated August 31, 2017 has reaffirmed the earlier decision of its Fourth Division disqualifying Mariano from holding to the position of member of the City Council and at the same time denied the councilor’s motion for reconsideration.

“My legal counsel and I doubt if we could still secure a TRO. However, we will exhaust all means possible,” Mariano told reporters in an interview.

However, the councilor revealed that he has already prepared himself for this day as he was somehow tired of receiving numerous communication letters from higher government offices regarding his disqualification case since last year.

He lamented the fact that he has to leave the City Council even just in the middle of his term as he also expressed concern on the welfare of his staff who will lose their jobs.

“I am saddened by the outcome of this case. But nevertheless, I am certain that I have served the city well. I did my job as a legislator and representative of my constituents in my district,” Mariano stressed.

Mariano is noted for being a workaholic legislator, fiscalizer, brilliant and eloquent by his colleagues in the local august body.

He is not new in the City Council after having been elected as councilor for at least three terms prior to the 2016 elections.

Vice Mayor Cesar Iturralde said that he considers Mariano as a great asset to the City Council after having been colleagues for more than ten years.

“Councilor Mariano has a splendid performance in the august body.  He always go to the session well prepared,” Iturralde stressed.—Jemuel E. Mojica
